Wage & Hour Rights and Responsibilities

Wage Payment: Employee rights consist of:- Pay for all wages made (INFO # 3) at the rate accepted by the employer and worker.

– Pay of a minimum of base pay (INFO # 1), the appropriate Colorado or regional minimum wage, and all earned overtime earnings without impermissible deductions from their incomes;.

– Pay of all made earnings without impermissible reductions (INFO # 16).

Labor Statutes, Rules, & Published Guidance

& Rules: DLSS implements much of Colorado’s wage and hour and other types of labor statutes and labor guidelines, consisting of the Colorado Wage Act, the Colorado Overtime and Minimum Pay Standards (” COMPS Order”), and the Equal Spend For employment Equal Work Act. Please go to the Division’s Labor Statutes and Labor Rules webpages for existing and previous variations of essential Colorado labor statutes and guidelines.

Published Guidance: The Division’s main types of public assistance are:- INFOs (Interpretive Notices and Formal Opinions) – the Division’s officially authorized notifications, viewpoints, and descriptions on various labor law topics; and.

– KNOWLEDGEs (Knowledge for Workers on Labor Law is Empowering & Drives Good Employment) one-page summaries for workers on their labor employment rights.

Written Demands, Complaints, & Investigations

Demands & Complaints for Wages: If a company owes you salaries, you can send your company a written demand for payment of earnings by mail, e-mail, text message, or other electronic ways. A written demand may be sent out to the company at the exact same time a Labor Standards Complaint Form for unsettled salaries is filed with the Division. The Labor Standards Complaint Form can be discovered on our Demands, Complaints, Responses, and Settlements web page.

Employer Responses in Investigations: Once a complete Labor Standards Complaint Form is received and evaluated, a letter describing the nature of the problem and the quantities alleged to be owed is sent out to the employer. Investigations Launched by the Division (” Direct Investigations”): The Division might perform employer-wide direct examinations of possible offenses of Colorado wage and hour law. If you want to submit a tip, please email the Division at cdle_di_tips@state.co.us. If you wish to submit a private claim for overdue salaries, you should submit a Labor Standards Complaint Form on our Demands, Complaints, Responses, and employment Settlements website. To appeal a direct examination citation or several Notices of Assessment, a supposed employer may submit a Direct Investigation Appeal Form.
